Description

The “Vagos and Maleantes” Law was approved in 1933, during the Second Republic. Even so, it was not until the reform of 1954, in accordance with the moral vision of national Catholicism, that homosexuality was incorporated as a behavior from which society needed to be protected. However, it must be borne in mind that this does not mean that she was not previously persecuted as well.

The Law on dangerousness and social rehabilitation of the year 1970 represents the normative relief of the Law of “vagos and maleantes”. In this way, the criminalization of homosexuality not only remains in force, but also limits its treatment in greater detail.

Thus, although the reform of the “vagos and maleantes” Law of 1954 had put it on the same level as “ruffians and pimps”, the Law on dangerousness and social rehabilitation considered homosexuality as a differentiated category.

It wasn’t until December 1978 that a deep revision of the states of danger took place and, along with other reforms, the legal reference to acts of homosexuality was deleted.
