Description

In 1163, Gaubert de Pau and his wife Flandina renounced the rights they claimed on half a farm located in the parish of Calabuig, in the county of Empúries, in exchange for 15 sous of Girona currency. This document, preserved in parchment at the bottom of the monastery of Santa Maria de Vilabertran, is a precious example of the way property conflicts were resolved in Catalan feudal society. The definition of rights, a common legal practice, made it possible to clearly establish land ownership and guarantee social peace. This case reflects the consolidation of the patrimonial power of the monasteries, which acted as spiritual centers but also as economic and administrative agents. The document shows us how, through writing, a legal and territorial order was built that connected Catalonia with European feudal practices.
